Terms of Service

lania.network (also “LANIA”, “LANIA.GG” or the “Service”) consists of the LANIA website, lania.network and its subdomains, and offers access to game servers through the lania.network website. The Contractor is Self-employed Kuzmin Egor Olegovich, TIN (INN) 773718443054.

0. Terms and definitions

For the purposes of this Agreement, the terms below, as used in the Agreement, have the following meanings and definitions, both in the plural and in the singular:

• “Website” — the website on the Internet located at lania.network;

• “Game server” — the game servers owned by LANIA, accessed through the Website and maintained by LANIA for the video game “Minecraft” by the developer Mojang AB, which are also an integral part of LANIA;

• “Services” — LANIA and its subsidiary services, owned in part or in full by LANIA.GG;

• “Server rules” — the internal rules policy of the Game servers;

• User — a Website visitor registered on LANIA who accepts the terms of this Agreement and wishes to use the services provided;

• “Account” — a page on LANIA that the User gets personal access to after registering and/or logging in on the Website, used for identification on LANIA and for access to the Game server;

• “Character” — the User’s game account, registered on the resources and licensed by the developer Mojang AB;

• “Content” — any information, including text, graphics, audio and video, posted by the User and/or the Services, that can be accessed using LANIA.

• “Subscription” — the opportunity for the User, for a fee and for a limited period of time, to obtain the right to access the Game servers for a Character, as provided by the developers Mojang AB, and to use additional non-activated data and commands on the Game Server.

1. General provisions

1.1. The parties to this Agreement are LANIA and the User, hereinafter jointly referred to as the “Parties”.

1.2. The relationship between LANIA and the User is governed by this Agreement and the current legislation of the Russian Federation.

1.3. This Agreement is a public offer. By registering on the Website, the User accedes to this Agreement and must follow all rules and fulfill all terms of the Agreement.

1.4. This Agreement takes effect when the User expresses consent to its terms by registering or creating an account through a third-party authorization service on the Website (acceptance). Before registering, the User must carefully read all provisions of this Agreement.

1.5. LANIA may unilaterally change and/or supplement the terms of this Agreement at any time without any special notice to the User. Such changes and/or additions take effect when the new version of the Agreement is published on the website. The User undertakes to regularly check the terms of this Agreement for changes and/or additions.

1.6. The User undertakes to use the Service only for personal non-commercial purposes, to comply with the terms of this Agreement, and not to violate the rights and legitimate interests of the Service and/or other Users.

1.7. If the User disagrees with any terms of this Agreement, the User undertakes not to use the Services in any form.

1.8. By accepting the terms of this Agreement, the Buyer automatically agrees to the established terms.

2. Subject of the Agreement

2.1. The subject of this Agreement is providing LANIA Users with services for purchasing Content, Digital goods (also - Goods), Subscriptions and other services.

2.2. LANIA provides Users with the following types of services:

• access to electronic content;
• access to LANIA’s search and navigation tools;
• access to information about Goods and about purchasing Goods;
• paid access to the Game servers (Subscription);
• other types of services offered on the pages of the Online Store.

2.3. This Agreement covers all LANIA services currently existing (actually operating), as well as any of their subsequent modifications and any additional LANIA services that appear later.

2.4. The User agrees that all services are provided in accordance with LANIA’s internal regulations. To receive a service, the User needs a computer or other suitable device that meets the required specifications, Internet access, and must complete registration (see Section 4 of the Agreement). All matters of obtaining Internet access, buying and setting up the relevant equipment and software are the User’s own responsibility and are not covered by this Agreement.

2.5. By registering on LANIA, the User agrees to receive informational messages, including advertising, by any means not prohibited by current legislation and applicable to this Agreement, including via the email address provided during registration. The User agrees that providing their email address is an action that reliably establishes their wish to receive the messages specified in this Agreement, and proper confirmation of the User’s consent to receive the messages specified in this Agreement.

3. Intellectual property

3.1. All results of intellectual activity that make up the Services (visual design elements, graphics, illustrations, logos, trademarks, computer programs, etc.) posted and used on the Services are the intellectual property of LANIA and/or are used by LANIA under an agreement with the rights holders. All results of intellectual activity that make up the Service and are posted on the Service are protected by the intellectual property legislation of the Russian Federation. Any use of the results of intellectual activity posted on the Service without proper permission from the Service or the lawful rights holder is illegal and may lead to court proceedings and to the offenders being held liable under civil, administrative and/or criminal law in accordance with the legislation of the Russian Federation.

3.2. The User understands and agrees that LANIA may remove and/or move (without notice) any results of intellectual activity posted on the Services (including Content) at its sole discretion, at any time, for any reason or no reason, including without limitation moving and/or removing results of intellectual activity.

4. User obligations

4.1. The User undertakes to respect the property and non-property rights of authors and other rights holders when using content that LANIA provides access to.

4.2. The User agrees not to take actions that may be considered:

• as violating Russian legislation or international law, including in the field of intellectual property;
• as disrupting the normal operation of the LANIA resource and Services;
• unauthorized access to Content and personal data;
• unauthorized access to the server and user accounts;
• probing, scanning or testing the security of the resource;
• TCP/IP spoofing;
• decoding, decompiling, disassembling or otherwise tampering with the resource’s software;
• interfering with other users’ use of the resource;
• using LANIA services to distribute spam of any kind;
• deliberately transmitting viruses and/or “hacking” LANIA Services or the network;
• using any automated systems to access the website, including commercial bulk download applications as a replacement for client software;
• as violating the confidentiality of information provided by other Users;
• circumventing, hacking, modifying or slowing down, including a distributed denial-of-service (DDoS) attack and/or other actions against the technical protection system of LANIA Services.

4.3. The User agrees not to reproduce, repeat, copy, sell or resell, or take other actions that may be understood in a similar way, and not to use any parts of LANIA Services for any commercial or other purposes.

4.4. The User is responsible for the security of their login and password, undertakes to take appropriate measures to keep the User’s account safe, and is responsible for all actions performed on the Services under their account (login and password). The User must notify LANIA immediately of any access to the Services by third parties under the User’s account.

4.5. The User may not transfer, assign, sell, lend, etc. their account on the Services (including access to the Game servers) to third parties without LANIA’s consent. The Service is not responsible for any loss or corruption of data that may occur due to the User’s breach of this part of the Agreement. LANIA may prohibit the use of certain logins and/or withdraw them from use.

4.6. The User hereby confirms that they have legal capacity and have reached the age of majority (18 years). An individual under the age of majority undertakes not to use LANIA without the consent of their parents or other legal representatives in accordance with the current legislation of the Russian Federation. For the avoidance of doubt, the User agrees that LANIA cannot verify the User’s age when the User accesses the Services, and therefore is not liable to the User for the possibility of accessing Content prohibited for children. Responsibility for breaches of this clause of the Agreement by an individual under the age of majority lies with their parents or other legal representatives in accordance with the current legislation of the Russian Federation. LANIA is not responsible for the lawfulness of the use of the Service and/or access to Content and/or payment by a User under the age of majority.

4.7. The User hereby confirms and agrees that accessing LANIA and the Game servers from devices that use unlicensed, unofficial or cracked software applications, operating systems, or other technical and software tools to access the Services is done at the User’s own risk. LANIA does not guarantee that the Services will work in that case. If the User does not comply with this clause, money paid for the Subscription and/or additional services is not refunded; LANIA is not responsible for the User’s failure to comply with this clause or to read it in time.

5. Subscription and Additional services

5.1. The cost of access to the Game servers is shown on the Website in the “Shop” section and depends on the length of the Subscription period.

5.2. The Subscription periods available to the User are shown on the corresponding screen of the payment form and appear in the personal account in the “My orders” section after the corresponding Subscription period is purchased.

5.3. By purchasing a Subscription and/or other Services, the User is considered to have accepted the Agreement and all documents referenced by the Agreement in full, without any reservations or exceptions.

5.4. LANIA’s obligations to provide the User with access to the Game servers and additional Services are considered fulfilled at the moment of payment and granting of access, regardless of whether the User requested the corresponding performance from the Service during the Subscription period, and regardless of actual use during the Subscription period.

5.5. LANIA may, at its discretion, give Users access to the Game servers or Additional services free of charge, i.e. as a promotion for a certain period. The duration of free access or Services is determined by LANIA, is shown on the corresponding page of the Service and may be changed by LANIA without prior notice to the User.

5.6. LANIA may at any time and without giving reasons suspend, for a period at the Service’s discretion, and/or terminate the User’s ability to use the Account (including the Subscription to the Game servers) unilaterally and out of court in case of a breach of this Agreement and/or the Server rules (see Section 0 of the Agreement). In this case the money paid by the User is not refunded.

5.7. In case of disputed or unclear situations, or if the User receives any third-party offers related to paying for the right to use the main or additional functionality of the Services, or if such ads and offers are posted on the Internet, the User must notify LANIA immediately. If the User, in breach of this agreement, paid in response to such an ad using the payment details given in it, the User’s claims against LANIA about lack of access to any of the functionality of the Services are not accepted, and LANIA does not compensate the User for money spent in such circumstances.

5.8. The User guarantees to the Service that they have the right to freely dispose of the funds chosen to pay for the Subscription or Services, without violating the legislation of the Russian Federation and/or of any other country of which the User is a citizen, or the rights of third parties. LANIA is not responsible for any damage to third parties caused by the User’s use of funds that do not belong to them. The User understands and agrees that all actions performed through their Account are considered performed by the User.

5.9. The Service may change subscription plans and service prices. The Service will inform you of any changes to prices or your subscription plan before they take effect.

5.10. You can get a refund at any time if the refund rules have been followed.

6. Personal data

6.1. By accepting this Agreement, the User, in accordance with Federal Law No. 152-FZ of July 27, 2006 “On Personal Data”, decides to provide their personal data and consents to the Service processing (including receiving from the User) their personal data, and confirms that in giving such consent the User acts freely, of their own will and in their own interest.

6.2. The User hereby confirms and agrees that creating an account on the Website constitutes specific, informed and conscious consent to the processing of their personal data.

7. Links

7.1. The Services may contain links to external resources. Since LANIA does not control such resources, the User confirms that they visit and use external resources at their own risk. LANIA is not responsible for the operation of such websites or resources, nor for the content, advertising, materials, goods and services available on such websites or resources.

7.2. The User also agrees that LANIA is not responsible and has no direct or indirect obligations to the User in connection with any possible or actual losses or damages related to any content, goods or services available on or obtained through external websites or resources.

8. Other terms

8.1. The User and LANIA agree that all possible disputes related to this Agreement and the provision of services will be resolved in accordance with the current legislation of the Russian Federation.

8.2. Nothing in the Agreement may be understood as establishing between the User and the Online Store an agency relationship, partnership, joint venture, personal employment relationship or any other relationship not expressly provided for by the Agreement.

8.3. If a court finds any provision of this Agreement invalid or unenforceable, this does not make the other provisions of this Agreement invalid or unenforceable.

8.4. LANIA’s inaction in case of a breach of this Agreement by any User does not deprive LANIA of the right to take appropriate action to protect its interests later, nor does it mean a waiver of LANIA’s rights if similar or identical breaches are committed later.

8.5. The User confirms that they have read all clauses of this Agreement and accept them unconditionally.

8.6. The server rules are in the Game server rules section. By accepting the Terms of Use, you agree to and accept the Server rules.
